If it was a condition of sale that the other party be able to obtain financing, then no you couldn't sue. If it's not in there you may have a case, however it doesn't sound like these people have much money to begin with. Sounds like a blood from a stone situation.
References :
I'd say you have a very good case for a "Specific Performance" breach of contract suit, and can force the seller to close.

Why would they be getting financing on a mortgage they have against the house they were selling??? Would this not have been paid when you bought the house??? If that's the case they did not have MARKETABLE TITLE which then becomes a liability of their real estate company.

You need a good real estate attorney. Get rid of the guy you have now.
References :
http://www.fsboamerica.org/Real-Estate-Specific-Performance-.cfm

Realtors can give you a comparable market analysis, which is reviewing similar properties and making an assessment of what the value of your house is.

They cannot do appraisals without being licensed to do so.
References :
Oregon Realtor

the law has been discussing this matter. The courts are suggesting
that the tenant, when in doubt, open a new checking acct and
put the money for rent into that acct ---or open an escrow account
to hold the money for the rightful rent collector.

IF you show the acct data to the Pm or whomever, they can proceed
to take you to court for non payment and that is OK. Go to court
and show the judge your rent payment account and why you are
withholding rent......you are unsure of the legal owner. the judge
will then direct the PM or whomever to satisfy the court that they
have legal rights to collect. When the court is satisfied, the
judge will direct you to pay that person.

also, you can quickly tomorrow. call any title firm or the county
recorder and ask who the legal owner is.

your hesitancy to pay in this situation is smart
References :
RE broker
